物件探し⑦ 建築基準法 / House Hunting 7: Construction Standard Act
丹波の古民家物件を見て以来、私たちの心は立派な梁や柱のことでいっぱいになりました。そこで、他に古民家物件がないか探そうと思い、探しているうちに、この地域の地方自治体が運営するサイトに行き着きました。

地方では人口減少と高齢化の対策に、自治体が地方移住希望者をサポートする取組を行い、その中で物件売買の斡旋もしています。私はこれらのサイトを確認して、いくつかよさそうな物件を見つけました。
一方、先日、丹波で見た物件については、詳細を確認しているうちに、建築基準法上の問題点があることに気づきました。建築基準法では、家が建てられる土地というのは、幅４メートル以上の道路に２メートル以上接していなければなりませんが、この家は全く道路に接していません。小川が家のすぐ横を流れていて、その小川に架けられた幅1メートルの橋が唯一この家に行く方法でした。
110年前に家が建てられたときは建築基準法はありませんでしたが、今はあります。
既存の家に住み、リノベーションもできるかもしれませんが、再建築はできません。
また、仮に、既存のままでリノベーションすると決めたとしても、工事のための車もトラックも敷地に入ることができず、建築費用が無駄に高くなると予想されます。
以上のような理由から、この家は諦めることにしました。
After we visited Komina (Old Folk House) in Tanba, our mind was dominated by the house built with splendid timber. So I looked for other ones and reached online sites operated by local governments in that area.

As the number of local population is decreasing and local cities are becoming aging society, they are working on the project to support people who want to migrate to countryside including sell/purchase of properties. I checked their sites and found some.
Regarding the Kominka we visited on the other day, I checked the details of the property and found a difficulty due to the Construction Standard Act. According to the law, house can only be built on the land that touches the road with a width of 4 meters or more, and the length of the border should be at least 2 meters.
The land of the house didn’t touch any road. A stream flows just by the house, and a small bridge over the stream, which is just 1 meter wide, was the only way to reach the house.
The law didn’t exist when the house was built 110 years ago but now it does. We are allowed to live in the existing house and may be able to renovate the inside, but cannot rebuild it. And even if we are allowed to renovate it, no cars or trucks for renovating work can get close to the house and the cost of construction would be higher.
Because of this reason, we gave up this property.
